Pension Funding Relief - What's In, What's Not and How It Works

This course will provide information for multiemployer and single employer plans. The Preservation of Access to Care for Medicare Beneficiaries and Pension Relief Act of 2010, H.R. 3962, became law on June 25.

For multiemployer plans

  • How the relief works to give plans more time to make up for the investment losses incurred in 2008 and 2009
  • The solvency-based test to determine whether a multiemployer plan is eligible to use the funding relief
  • The restrictions on plan amendments increasing benefits

For single employers

  • What the extended amortization options are
  • How the legislation affects benefit restrictions
  • The principle features of the ‘cash-flow rule’ that links the availability of funding relief to the employer’s decisions on executive compensation and certain types of shareholder distributions
  • An overview of special rules for charitable organizations and government contractors
  • A brief guide to the many other details and special rules.

Both presenters will note areas of uncertainty in the legislative language and their implications.
